Welcome to Six Degrees Housing! Please read these Terms of Use ("Terms") carefully. These Terms are a legal agreement between you and Six Degrees Housing Int'l, LLC. ("Six Degrees Housing") and govern your access to and use of the SixDegreesHousing.com website (the "Site"). By registering an account and/or by accessing or using the Site, or you acknowledge that you have read, understood and agreed to be bound by these Terms. If you do not agree to these Terms, you must exit the site immediately and discontinue any use of the Site or information from the Site.

ABOUT SIX DEGREES HOUSING INT'L, LLC

We do not own nor can we contract for any rental property listed on the Site. Instead, the Site acts as a venue to allow a member of our Site to offer for rent, or rent, in a variety of pricing formats, a specific rental property to potential renters. We are not involved in the actual transaction between users and members even though we may from time to time provide tools, such as direct booking, that enable a user to enter into a transaction to lease a specific property directly from the member of that property. As a result, the quality, safety or legality of the properties advertised, the truth or accuracy of the listings (including the content thereof or any property or guest book review), the ability of members to rent property or the ability of users to pay for rental properties are solely the responsibility of each user.

MODIFICATIONS TO THE TERMS

We reserve the right, in our sole discretion, to change, add, delete or otherwise modify any portion of these Terms at any time, without further notice. Modifications to these Terms will be effective immediately upon posting on the Site. Your continued access to or use of the Site following the posting of such modifications constitutes your acceptance to the new Terms. It is your responsibility to review these Terms on a regular basis to keep yourself apprised of any changes. If you object to any provision or condition of the Terms, or any subsequent modifications, or become dissatisfied with the Site in any way, your only recourse is to immediately discontinue use of the Site and terminate your account.

REGISTRATION OF ACCOUNTS

If you choose to offer a property for rental, you must follow the registration process on the Site to create an account. You agree to provide Six Degrees Housing with current, complete and accurate information as requested by any forms. You certify that you have the legal right to rent out this property and that this is the property you are advertising here. If you choose to post photos of an available property, you agree to post genuine photos of such property, not standardized, fake or misleading photos. You must create a separate posting for each property you offer for rental, except if you are offering multiple units within one property, you may choose "Corporate" under the "Listing Type" tab when Posting the Property. Fees relating to accounts for single properties and multiple units within a property are set out on the FAQ page. You are responsible for safeguarding any password that you use to access any areas of the Site. You agree not to disclose your password to any third party. You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You will immediately notify Six Degrees Housing of any unauthorized use of your password.

FEES

The site is free to use. Six Degrees Housing reserves the right to change its billing practices to include yearly fees or any other billing it sees fit.

TERMINATION OF ACCOUNTS

You may cancel at any time by clicking "Unpublish" on the complete page of your posting page in your Account. Cancellation of your property will be effective immediately. Upon cancellation your posting will be put into "Unpublish / Draft" mode and will not be visible by Users. Your posting may be reinstated at any time.

THIS SITE IS AN ONLINE ADVERTISING VENUE AND RESEARCH TOOL

We are not a party to any rental transaction between landlords (including, as applicable, their authorized agents). You understand that we do not own nor can we contract for any rental property listed on the Site. As a result, Six Degrees Housing does not (i) guarantee or ensure any apartment or any transaction between a renter and landlord, (ii) collect or process payment or execute any lease or sublease documentation on behalf of renters or landlords, or (iii) broker, lease, or sublease or offer to broker, lease or sublease, or own any rental properties. Instead, the Site acts as an online advertising venue to enable landlords (or their agents) to offer for rent, or rent, in a variety of pricing formats and currencies, as applicable, a specific rental property to potential renters (collectively, the "Users").

We are not involved in the actual transaction between Users. As a result, the quality, safety or legality of the properties advertised, the truth or accuracy of the listings (including the content thereof or any property or guest book review), the ability of landlords (or their agents) to rent property (such as necessary approvals or other requirements) or the ability of renters to pay for rental properties are solely the responsibility of each user. It is the responsibility for each user to do his/her own due diligence throughout the entire rental process.

RESPONSIBILITY FOR CONTENT POSTED BY USERS

You understand that all postings, text, files, images, photos, reviews or other materials ("User Content") posted on, transmitted through, or linked from the Site, are the sole responsibility of the person from whom such User Content originated. More specifically, you are entirely responsible for each individual item of User Content that you post, email or otherwise make available via the Site. You acknowledge that Six Degrees Housing has no duty to, and does not, pre-screen or approve User Content but that Six Degrees Housing shall have the right (but not the obligation) in its sole discretion to decline to permit the posting of, or to delete or move, User Content that fails to meet with our content guidelines, that violates the letter or spirit of the Terms, or for any other reason.

You understand that Six Degrees Housing does not control, and is not responsible for User Content made available through the Site, and that by using the Site, you may be exposed to User Content that is misleading or otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any User Content, and that under no circumstances will Six Degrees Housing be liable in any way for any User Content or for any loss or damage of any kind incurred as a result of the use of any User Content posted, emailed or otherwise made available via the Site.

PRIVACY AND INFORMATION DISCLOSURE

Six Degrees Housing has established a Privacy Policy to explain to Users how information is collected and used. The terms of our Privacy Policy, and any notices regarding the Site sent to you or posted on the Site are incorporated into and made part of these Terms. Links to these policies and notices can be found on the Six Degrees Housing Home Page.

Your access to or use of the Site signifies your acknowledgment of and agreement to our Privacy Policy which is incorporated by reference. Please read this Privacy Policy carefully.

PROPRIETARY RIGHTS

Unless otherwise provided within these Terms, or unless otherwise applicable law requires us to allow you to do so, you may not do any of the following without the prior written consent of Six Degrees Housing:

• Copy, reproduce, upload, post, display, republish, distribute, or transmit any part of the content of this Site in any form whatsoever;
• Reproduce any portion of the Site on your website or otherwise, using any device including, but not limited to, use of a frame or border environment around the Site, or other framing technique to enclose any portion or aspect of the Site, or mirror or replicate any portion of the Site;
• Modify, translate into any language or computer language, or create derivative works from, any content or any part of this Site;
• Reverse engineer any part of this Site;
• Sell, offer for sale, transfer, or license any portion of the Site in any form to any third parties;
• Use any robot, spider, other automatic device, or manual process to monitor, copy, or keep a database copy of the content or any portion of the Site;
• Use the Site other than to advertise and/or research rentals and to make legitimate inquiries to our members;
• Use the Site to make any false, fraudulent or speculative reservation or inquiry, or any reservation in anticipation of demand;
• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law or for any other purpose that is unlawful or prohibited by these Terms;
• Post or transmit any information that constitutes or contains false or misleading indications of origin or statements of fact;
• Use or access the Site in any way that, in our sole discretion, adversely affects the performance or function of the Site, or any other computer systems or networks used by us or the Site, or infringes on our copyright or any copyright of our members;
• Violate, plagiarize or infringe the rights of third parties including, without limitation, copyright, trademark, patent, rights of publicity or privacy or any other proprietary rights;
• Upload or transmit to the Site or use any device, software or routine that contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that may damage, interfere or attempt to interfere with, or intercept, the normal operation of the Site, or appropriate the Site or any system, or take any action that imposes an unreasonable load on our computer equipment, or that infringes upon the rights of any third party; or
• Disguise the origin of any information or inquiry transmitted through the Site.

All trademarks, service marks and trade names that appear on the Site are proprietary to Six Degrees Housing or other respective owners. You may not display or reproduce these trademarks, service marks or trade names other than with the prior written consent of Six Degrees Housing, and you may not remove or otherwise modify any trademark notices from any content, text, images or other materials received through the Site.

USER CONDUCT; PROHIBITED ACTIVITIES

You understand that the Site is available for the specific uses of advertising and researching vacancies, renting properties and legitimate communications and inquiries between prospective renters and landlords regarding such vacancies. As such, this paragraph contains a partial list of the kinds of activities that are prohibited on the Site. You agree not to harvest or collect email addresses or other contact information of members from the Site by electronic or other means for the purposes of sending spam, unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Site or for any other purpose. You further agree that you may not use the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site. In addition, you agree not to use the Site to: upload, post, email, transmit or otherwise make available any content that we deem to be harmful, threatening, abusive, harassing, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable; impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity; upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; intimidate or harass another; use or attempt to use another's account, service or system without authorization, or create a false identity on this Site.

USER REPRESENTATIONS AND WARRANTIES

As an express condition of your access to and use of the Site, you hereby represent and warrant that (i) you have the right, authority, and capacity to agree to and to abide by these Terms; (ii) you have all necessary authority, rights and permissions to submit your User Content to the Site; (iii) your User Content does not and will not violate, infringe upon or misappropriate the rights of any third party, including but not limited to, copyright, trademark, trade secret, patent or other intellectual property right, rights of privacy or publicity, (iv) your User Content does not and will not contain any libelous or defamatory material; (v) your User Content does not and will not violate any applicable federal, state, or local law or regulation including, but not limited to, any fair housing laws or regulations, or cause injury to any person; and (vi) you will not use the Site in any way prohibited by the letter or spirit of these Terms.

RESPONSIBILITY FOR USER-CONTRIBUTED CONTENT

We have no duty to pre-screen content posted on the Site by members, or other users (including, without limitation, reviews of or guest book, if applicable, entries for any particular rental property), (collectively, "user-contributed content"), and we are not responsible for user-contributed content. We do, however, reserve the right to decline to permit the posting on the Site of, or to remove from, any user-contributed content that fails to meet our content requirements. We may also remove user-contributed content.

All property listings on the Site are submitted by the member and are the responsibility of the member, and we specifically disclaim any and all liability arising from the alleged accuracy of the listings, property reviews, guest book entries, or any alleged breaches of contract on a member's part. Members are solely responsible for keeping their property information up to date on the Site, including, but not limited to any and all representations about any property, its amenities, location, and its availability for a specific date or range of dates. We do not represent or warrant that any of the copy, content, property reviews, guest book entries, property location, suitability, pricing or availability information published on the Site is accurate or up-to-date even in the case where prospective users have searched for specific special offers, dates, or types of properties. Members are solely responsible for ensuring the accuracy of any property descriptions. However, we reserve the right at all times to disclose any information as permitted by prevailing law to satisfy any law, regulation or government request.

TERMINATION OF USE BY SIX DEGREES HOUSING

You agree that Six Degrees Housing, in its sole discretion, has the right (but not the obligation) to terminate, delete and deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Site (or any part thereof), immediately and without notice, and remove and discard any User Content you posted for any reason, including, without limitation, if Six Degrees Housing believes that you have acted inconsistently with the letter or spirit of the Terms. Further, you agree that Six Degrees Housing shall not be liable to you or any third-party for any termination of your access to the Site. Further, you agree not to attempt to use the Site after said termination.

LINKS TO OTHER WEBSITES

The Site may contain links to third-party websites or resources. You acknowledge and agree that Six Degrees Housing makes no representation or warranty and is not responsible or liable for the availability, accuracy, or completeness of such third-party websites or resources, or the content, products or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Six Degrees Housing thereof or the content, products or services available from such websites or resources. If you decide to access any such third-party websites or resources, you do so entirely at your own risk, and you may be subject to the terms and conditions and the privacy policies of such websites. Six Degrees Housing also makes available a web link for each listing to link to an outside website that is solely for the use of representing the property being rented on this particular listing. It is not allowed to use this link for any other property or advertisement of for any other purpose whatsoever.

LIMITATION OF LIABILITY

IN NO EVENT WILL SIX DEGREES HOUSING, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, OWNERS, AGENTS, PARTNERS AND/OR EMPLOYEES BE LIABLE FOR ANY LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THE SITE, THESE TERMS, YOUR USE OF THE SITE AND/OR ANY TRANSACTION BETWEEN USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6) ANY OTHER CAUSE OF ACTION, TO THE MAXIMUM EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU ARE DISSATISFIED WITH THE SITE, YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST US, ANOTHER USER OR THE SITE WITH RESPECT TO THESE TERMS OR THE SITE, THEN YOUR SOLE AND EXCLUSIVE REMEDY AGAINST US IS TO DISCONTINUE USING THE SITE. IN ALL EVENTS, OUR LIABILITY TO YOU OR ANY THIRD PARTY IN ANY CIRCUMSTANCE ARISING OUT OF OR IN CONNECTION WITH THE SITE IS LIMITED TO THE AMOUNT YOU PAID TO US.

IN THE EVENT THAT YOU HAVE A DISPUTE WITH ONE OR MORE OTHER USERS OF THE SITE OR ANY DISAGREEMENT WHATSOEVER BETWEEN OWNERS AND RENTERS (INCLUDING, WITHOUT LIMITATION, ANY DISPUTE BETWEEN USERS REGARDING ANY TRANSACTION, PROPERTY DISAGREEMENT OR USER CONTENT), YOU HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE SIX DEGREES HOUSING, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, OWNERS, AGENTS, PARTNERS AND/OR EMPLOYEES FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABLITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH SUCH DISPUTE AND/OR YOUR USE OF THE SITE.

INDEMNITY

YOU AGREE TO INDEMNIFY AND HOLD SIX DEGREES HOUSING, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, OWNERS, AGENTS, PARTNERS AND/OR EMPLOYEES, HARMLESS FROM AND AGAINST ANY AND ALL LOSS, LIABILITY, COST, CLAIM, OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES AND COURT COSTS, MADE BY ANY THIRD PARTY DUE TO, OR ARISING OUT OF OR IN CONNECTION WITH, USER CONTENT YOU SUBMIT, POST OR MAKE AVAILABLE THROUGH THE SITE, YOUR USE OR MISUSE OF THE SITE (INCLUDING, WITHOUT LIMITATION, ANY DISPUTE BETWEEN USERS REGARDING ANY TRANSACTION OR ANY USER CONTENT), YOUR VIOLATION OF THE TERMS, YOUR BREACH OF ANY OF THE REPRESENTATIONS AND WARRANTIES HEREIN, OR YOUR VIOLATION OF ANY LAW OR RIGHTS OF A THIRD PARTY. WE RESERVE THE RIGHT, AT OUR OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY YOU AND YOU SHALL NOT IN ANY EVENT SETTLE ANY MATTER WITHOUT OUR WRITTEN CONSENT.

CONTROLLING LAW AND JURISDICTION

THESE TERMS AND ANY DISPUTE ABOUT OR INVOLVING THE SITE SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICT OF LAW PROVISIONS. YOU AGREE FURTHER TO SUBMIT TO THE PERSONAL AND EXCLUSIVE JURISDICTION OF THE COURTS LOCATED WITHIN THE COUNTY OF NEW YORK, NEW YORK AND WAIVE ALL DEFENSES OF LACK OF PERSONAL JURISDICTION AND FORUM NON CONVENIENS. ANY CAUSE OF ACTION BY YOU WITH RESPECT TO THE SITE MUST BE INSTITUTED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE OR BE FOREVER WAIVED AND BARRED.

NOTIFICATION OF CLAIMS OF COPYRIGHT INFRINGEMENT

Six Degrees Housing expects the Users of the Site to respect the copyrights of others. It is a violation of the Terms for a User to post material that infringes the copyrights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please send your notification of claimed infringement to Six Degrees Housing's designated agent for copyright complaints as follows:

ENTIRE AGREEMENT; GENERAL INFORMATION

These Terms and the other policies and guidelines and rules that may be referenced herein constitute the entire and exclusive agreement between you and Six Degrees Housing with respect to your access to and use of the Site. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the said provision, and the other provisions of the Terms shall remain in full force and effect. The failure of Six Degrees Housing to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.
